Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of the website, applications, and services operated by Farmbite ("Farmbite", "we", "us") that enable users to list, search, and enquire about rural, farm, and agricultural property in Australia (the "Services"). By creating an account, listing a property, or otherwise using the Services, you agree to these Terms. If you are using Farmbite on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Eligibility & accounts

You must provide accurate registration information and keep it current. You are responsible for all activity under your credentials. Notify us promptly of unauthorised use. We may suspend or terminate accounts that violate these Terms or pose risk to other users or the platform.

3. Nature of the platform

Farmbite is a marketing and discovery platform, not a real estate agency, valuer, solicitor, or financial adviser. We do not guarantee that any listing will sell, that information is complete or current, or that buyers and sellers will complete a transaction. Users must conduct their own due diligence, inspections, and legal/financial advice — consistent with standard practice on property listing websites.

4. Listings & content

• You grant Farmbite a non-exclusive, worldwide licence to host, display, distribute, and promote your listing and related content (including images) for the purpose of operating and marketing the Services.
• You warrant that you have rights to submit the content, that listings are not misleading, and that you comply with applicable laws (including Australian Consumer Law where relevant, and state/territory property advertising rules).
• Licensed agents and agencies are responsible for ensuring their use of Farmbite aligns with their regulatory obligations and agency agreements.
• We may remove or refuse content that breaches these Terms, infringes third-party rights, or harms the integrity of the marketplace.

5. Subscriptions, fees & payments

Certain features require a paid subscription (e.g. Owner, Agent, or Agency plans). Pricing, inclusions, and billing cycles are described on our Pricing page and at checkout. By subscribing, you authorise us (and our payment processor) to charge the applicable fees using your selected payment method.

• Billing: Fees may be billed weekly, monthly, or annually as offered. Taxes (e.g. GST) may apply where required by law.
• Renewals & changes: Subscriptions may renew automatically until cancelled. We may change plan prices or features with reasonable notice; continued use after the effective date may constitute acceptance.
• Cancellation: You may cancel according to in-product controls or by contacting support. Refunds (if any) are governed by the refund policy stated at purchase or as required by law.
• Failed payments: We may suspend paid features until payment succeeds.
• Future payment features: Additional payment products (e.g. one-off boosts, lead fees, or integrated escrow) may be introduced under supplementary terms or checkout disclosures.

6. Enquiries & communications

Enquiry tools connect interested parties; Farmbite is not a party to negotiations or contracts between users. You agree not to misuse enquiry systems (spam, harassment, or automated scraping contrary to our rules or robots.txt).

7. Acceptable use

You must not:

• Violate law or third-party rights; upload malware; or attempt unauthorised access to our systems.
• Scrape or bulk-harvest data without permission; circumvent technical limits or paywalls.
• Post discriminatory, defamatory, or illegal content; or impersonate others.
• Use the Services to facilitate fraud in property transactions.

8. Intellectual property

Farmbite branding, software, and layout are protected by intellectual property laws. Except for your own content and licence grants herein, you receive no ownership rights. Feedback you provide may be used by us without obligation to you.

9. Disclaimers

To the maximum extent permitted by Australian law, the Services are provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where permissible. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right that cannot be excluded under the Australian Consumer Law.

10. Limitation of liability

Subject to the preceding section, to the extent permitted by law Farmbite and its directors, employees, and suppliers are not liable for indirect, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for claims relating to the Services (except where prohibited) may be limited to the amount you paid us in the twelve months before the claim, or AUD $100 if you have not paid fees — whichever is greater, unless a higher minimum applies under statute.

11. Indemnity

You agree to indemnify and hold harmless Farmbite against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your listings, your breach of these Terms, or your violation of third-party rights — except to the extent caused by our gross negligence or wilful misconduct.

12. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach, risk, or operational reasons. Provisions that by nature should survive (e.g. liability limits, indemnity, governing law) survive termination.

13. Governing law

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of courts in the State or Territory we nominate from time to time (or, if none, New South Wales).

14. Changes to Terms

We may modify these Terms. We will post the updated Terms and update the "Last updated" date. For material changes, we may provide additional notice. Continued use after the effective date may constitute acceptance where permitted.
