1. Introduction

Farmbite ("Farmbite", "we", "us", or "our") operates an online platform for listing, searching, and enquiring about rural and agricultural property in Australia. This Privacy Policy explains how we collect, use, store, disclose, and protect personal information when you use our website, mobile experiences, and related services (collectively, the "Services").

By using the Services, you acknowledge this Policy. If you do not agree, please do not use Farmbite. Australian Privacy Principles under the Privacy Act 1988 (Cth) and applicable state/territory laws inform how we handle personal information.

2. Information we collect

2.1 You provide directly

  • Account & profile: name, email, phone, organisation or agency name, profile photo, bio, and public slug where you choose to publish an agent or agency profile.
  • Listings: property descriptions, addresses or regions, pricing, land size, images, videos, and other content you submit for publication.
  • Enquiries & communications: messages you send via enquiry forms, email, or in-product notifications.
  • Billing (present and future): if you subscribe or pay for plans, we (or our payment processor) may collect billing name, address, payment method tokens, and transaction metadata. We do not store full card numbers on Farmbite servers when processing is delegated to a PCI-compliant provider.

2.2 Automatically

  • Technical data: IP address, device type, browser, approximate location derived from IP, pages viewed, and timestamps — used for security, analytics, and service improvement.
  • Cookies & similar technologies: to keep you signed in, remember preferences, and measure traffic. You can control cookies via browser settings; some features may not work if disabled.

2.3 Third parties

We may receive information from authentication providers, mapping or imagery services, or analytics tools integrated with the platform, subject to their policies and your settings.

3. How we use personal information

  • Provide, operate, and improve the Services (including search, listings, directories, and dashboard tools).
  • Create and manage accounts; authenticate users; display public profiles and listings you choose to publish.
  • Facilitate enquiries between users and listing parties; send service-related emails and notifications.
  • Process or prepare for subscriptions and payments (including plan changes, receipts, fraud prevention, and tax records where required).
  • Comply with law; respond to lawful requests; enforce our Terms and policies; protect rights and safety.
  • Analyse aggregated or de-identified usage to improve product design and marketing (where permitted).

4. Disclosure of information

We may share personal information with:

  • Other users: information you place on public listings, agent/agency pages, or enquiry flows becomes visible as designed (similar to other property listing websites).
  • Service providers: hosting, database, email, analytics, customer support, and payment processing — under contracts requiring appropriate confidentiality and security.
  • Professional advisers & authorities: lawyers, accountants, or regulators where required or permitted by law.
  • Business transfers: in connection with a merger, acquisition, or asset sale, with notice where practical.

We do not sell your personal information as a commodity. We may use third-party analytics that process data on our behalf under agreement.

5. Overseas disclosure

Our infrastructure or subprocessors may be located outside Australia (for example, cloud regions). Where we disclose personal information overseas, we take steps that are reasonable in the circumstances to ensure the recipient handles it consistently with Australian privacy law, including through contractual safeguards where applicable.

6. Security

We implement technical and organisational measures appropriate to the nature of the data (including encryption in transit, access controls, and secure development practices). No method of transmission or storage is 100% secure; you use the Services at your own risk to that extent.

7. Retention

We retain personal information for as long as needed to provide the Services, comply with legal obligations (including tax and financial record-keeping for payments and subscriptions), resolve disputes, and enforce agreements. Listing and profile content may remain visible until you delete it or close your account, subject to backup and archival cycles.

8. Your rights

We may need to verify your identity. If you are unsatisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC).

9. Marketing

We may send product updates or promotional messages where permitted. You can opt out of non-essential marketing via unsubscribe links or by contacting us. Transactional and security-related messages may continue.

10. Children

Farmbite is not directed at children under 16. We do not knowingly collect personal information from children. If you believe we have, please contact us and we will take steps to delete it.

11. Changes

We may update this Policy from time to time. The "Last updated" date will change, and for material changes we may provide additional notice (e.g. email or banner). Continued use after changes constitutes acceptance where permitted by law.
